Disclaimer in Accordance with Transport Canada Bareboat Regulations and the Canada Shipping Act, 2001

By signing below, I, the RENTER, acknowledge and confirm the following:

1. I am solely responsible for the Vessel during the rental period and assume all liability for its operation, safety, and any actions of guests or invitees aboard.

2. I understand that the Vessel must be used solely for personal recreational purposes and may not be used for any commercial purpose, including but not limited to carrying passengers for compensation, hosting events for payment, tours, or any other activity in violation of the Canada Shipping Act, 2001 and Transport Canada’s Ship Safety Bulletin No. 19/2024.

3. I agree that no person onboard the Vessel shall provide compensation, directly or indirectly, for the purpose of being carried on the Vessel or participating in the outing. I further agree that no pooled, shared, or third-party payments will be collected or used in connection with the use of the Vessel. I acknowledge that any such activity may result in the Vessel being considered a non-pleasure craft under applicable law, including the Canada Shipping Act, 2001, and I accept full responsibility for ensuring compliance with all applicable laws and regulations.

I further agree that no person onboard shall provide compensation, directly or indirectly, to the OWNER or any associated person in connection with the use of the Vessel, and that all payments related to the Vessel rental shall be made solely by me as the RENTER.

5. I am aware that the OWNER shall not be present onboard the Vessel during the rental period unless personally invited by me for social purposes only, and any such presence shall be strictly non-operational in nature.

6. I understand that I may select and hire my own operator or captain, and that any recommendation by the OWNER is non-exclusive and purely for informational purposes. The OWNER does not provide, assign, or control any captain, crew, or operator.

7. I understand that the legal classification of the Vessel depends on how it is used in practice, and I accept full responsibility for ensuring that the Vessel is used strictly for personal recreational purposes in compliance with all applicable laws and regulations.

8. I acknowledge that I must retain full control over the Vessel during the rental period, including the exclusive right to select, hire, and direct any captain or crew.

9. I acknowledge that I have reviewed Schedule “A” (Transport Canada Pleasure Craft Fact Sheet) and understand the distinction between a pleasure craft and a non-pleasure craft.

I acknowledge that I am renting this Vessel for personal recreational use only, and that I accept all responsibilities as RENTER.
