Disclaimer in Accordance with Transport Canada Bareboat Regulations and the Canada Shipping Act, 2001
As the Charterer, you acknowledge and agree that the vessel shall be used exclusively as a pleasure craft for the sole and proper use of yourself, your students, and your guests during the term of the charter. You are expressly prohibited from transporting merchandise for hire, carrying passengers for hire, engaging in any commercial activity, or otherwise violating any applicable laws or regulations established by Transport Canada.
During the charter term, you shall have full possession and control of the vessel, including the exclusive authority to appoint the master and crew. While we may provide a list of qualified captains for your consideration, you are free to select and hire your own master or crew, subject to our approval.
The vessel owner may offer to serve as master at your discretion. Alternatively, you may provide your own captain, provided that they meet our standards, hold a valid Master 60 license, and submit a video demonstrating their ability to dock a vessel of 50 feet or more in length and 20,000 pounds or more in displacement, without the use of bow or stern thrusters.
Please be advised that no guest or invitee aboard the vessel may offer or provide any form of direct or indirect payment, gratuity, compensation, or consideration to the vessel owner, operator, or any member of the crew. All financial responsibilities related to the charter—including, but not limited to, payment for the vessel, captain, crew, and fuel—shall be borne solely by the individual who has booked the charter.
